Welcome to SomaYama® BREATH! These Terms & Conditions ("Terms") govern your access to and use of the SomaYamaBREATH.com website (the "Site") and the services offered by SomaYama® BREATH, operated by Norm and Toni Poulsen, including all Somatic Breathwork sessions (1-on-1, Group, in-person, online, and custom packages) (collectively, the "Services").

By accessing or using the Site or Services, you agree to be bound by these Terms and our Privacy Policy. If you do not agree to these Terms, please do not access or use the Site or Services.

1. Acceptance of Terms

By using our Site or Services, you affirm that you are at least 18 years of age and are capable of entering into a legally binding agreement. You agree to comply with all applicable laws and regulations regarding your use of the Site and Services.

2. Services Description

SomaYama® BREATH provides trauma-informed Somatic Breathwork sessions aimed at facilitating emotional release, stress reduction, nervous system regulation, and personal growth. Our Services are offered in various formats, as described on the Site.

Important Disclaimer: Somatic Breathwork is a complementary wellness practice and is not a substitute for professional medical, psychological, or psychiatric advice, diagnosis, or treatment. Norm and Toni Poulsen are Certified Practitioners and Teachers of the SomaYama® Trauma Informed Somatic Breathwork method, but they are not licensed medical doctors, therapists, or mental health professionals. Always seek the advice of your physician or other qualified health provider with any questions you may have regarding a medical or psychological condition. Do not disregard professional medical advice or delay seeking it because of something you have read on this Site or experienced in our Services.

3. User Accounts

If you create an account on the Site for booking or other purposes, you are responsible for maintaining the confidentiality of your account login information and for all activities that occur under your account. You agree to notify us immediately of any unauthorized use of your account. We reserve the right to suspend or terminate your account at our sole discretion.

4. Booking and Payment

Booking: Services can be booked through the scheduling system on our Site or by contacting us directly. By booking a session, you agree to provide accurate and complete information.
Payment: Payment for Services is required in advance or at the time of booking, as specified on the Site or during the booking process. We use secure third-party payment processors and do not store your full payment card details. You agree to provide valid payment information and authorize us (or our third-party processor) to charge the applicable fees.
Pricing: Prices for Services are listed on the Site and are subject to change without notice.

5. Cancellations and Refunds

You may use the content on the Site for your personal, non-commercial use only. Any other use, including the reproduction, modification, distribution, transmission, republication, display, or performance, of the content on the Site is strictly prohibited without our express prior written permission.

7. User Conduct

You agree not to use the Site or Services for any unlawful purpose or in any way that could damage, disable, overburden, or impair the Site or interfere with any other party's use of the Site. You agree not to attempt to gain unauthorized access to any portion of the Site, other user accounts, or computer systems or networks connected to the Site.

During sessions (in-person or online), you agree to behave respectfully towards Norm, Toni, and other participants (in group settings). Disruptive or disrespectful behavior may result in removal from a session without refund.

8. Disclaimers

No Medical or Psychological Advice: As stated in Section 2, the Services provided are for wellness and personal growth and do not constitute medical, psychological, or psychiatric diagnosis, treatment, or advice.
Results Not Guaranteed: While Somatic Breathwork can be a powerful tool for healing and transformation, results vary from person to person. We do not guarantee any specific outcomes from participating in our Services.
"As Is" Basis: The Site and Services are provided on an "as is" and "as available" basis. We make no warranties, express or implied, regarding the operation of the Site or the information, content, materials, or products included on the Site.

9. Limitation of Liability

To the fullest extent permitted by applicable law, SomaYama® BREATH, Norm Poulsen, Toni Poulsen, and their affiliates, officers, employees, agents, partners, and licensors shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from (i) your access to or use of or inability to access or use the Site or Services; (ii) any conduct or content of any third party on the Site or Services; (iii) any content obtained from the Site or Services; and (iv) unauthorized access, use, or alteration of your transmissions or content, whether based on warranty, contract, tort (including negligence), or any other legal theory, whether or not we have been informed of the possibility of such damage.

You agree to defend, indemnify, and hold harmless SomaYama® BREATH, Norm Poulsen, Toni Poulsen, and their affiliates, officers, employees, agents, partners, and licensors from and against any and all claims, damages, obligations, losses, liabilities, costs, debt, and expenses (including but not limited to attorney's fees), resulting from or arising out of (i) your use of the Site or Services; (ii) your violation of these Terms; (iii) your violation of any rights of a third party, including without limitation any intellectual property right or privacy right; or (iv) any claim that your use of the Service caused damage to a third party.

11. Governing Law

These Terms shall be governed and construed in accordance with the laws of the State of Idaho, United States, without regard to its conflict of law provisions.

12. Changes to These Terms

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will try to provide at least 30 days' notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion.

By continuing to access or use our Site or Services after those revisions become effective, you agree to be bound by the revised terms. If you do not agree to the new terms, please stop using the Site and Services.
